Buying Process on the Costa del Sol – Step by Step
1. Viewing and Bidding
After viewings, bidding and negotiation, the buyer and seller agree on a final sales price.
2. Reservation Contract
(Contrato de Reserva)
This is a simple agreement setting out the purchase price, payment terms, expected date of signing the title deed, included furniture and whether the purchase is subject to a mortgage. A reservation deposit of approximately €6,000 is normally paid.
The reservation contract is either signed at the broker’s office or sent to the buyer by email for signature.
3. Legal Examination and Due Diligence
The solicitor contacts the seller’s legal representative and gathers all relevant documentation for the property. This includes verifying that all permits and licences are in order and that there are no outstanding debts, mortgages, community fees, tenants or unpaid taxes associated with the property.
4. Private Purchase Contract
(Contrato de Compraventa)
Once the legal checks are completed and everything is confirmed to be in order, the buyer and seller sign the private purchase contract. This detailed agreement includes a legal description of the property, personal details of both parties, the purchase price, payment schedule and estimated date of signing the title deed.
At this stage, the buyer usually pays 10% of the total purchase price.
5. Title Deed
(Escritura de Compraventa)
The final step takes place at a notary office. Both parties, either in person or represented by their solicitors with power of attorney, sign the title deed. The remaining purchase price is paid, and the keys are handed over to the buyer.
From this moment, the buyer becomes the legal owner of the property.
6. Registration of the Purchase
After signing the title deed, it is registered at the Land Registry in the buyer’s name. The solicitor ensures that all taxes, transfer fees and legal costs are paid, and that utility contracts, community fees and property-related taxes are transferred to the new owner.
