Brokerage fee
Brokerage fee on Costa del Sol is normally 5% + 21% IVA (Spanish VAT)
Legal fees
The cost of hiring a lawyer for the sale is approx. 1 % + IVA
Plusvalía
Plusvalia (value added tax on the land) is a local capital gain tax on the value increase of the land on which the dwelling is situated. The amount is calculated based on the time the purchase of the property combined with the tax value.
Capital gains tax
Capital gain tax is the tax the seller have to pay on the profit he makes on his sale. As a resident you pay 19% up to 6000 euros and 21% up to 50 000€. Non-residents are generally subject to a flat capital gains tax rate of 19%. If the seller is not a resident (permanent resident) in Spain, the buyer through his lawyer have to retain 3% of the sales amount as an “advance” of any capital gain. If there is no gain, the Spanish tax authority (Hacienda) will refund this amount within 6 months but this is not made automatically. You will have to tell your lawyer to apply for the refund. If the capital gain is greater than 3% of the sales value, the seller will pay this.
WHEN IS THE BEST TIME TO SELL YOUR HOME?
The real estate market on the Costa del Sol mirrors global trends, with distinct seasonal patterns. The high season for transactions typically begins in late March and runs through to late June. Activity slows during the peak summer months but picks up again from late August through early December. Despite these seasonal fluctuations, there is consistent buying and selling activity year-round on the Costa del Sol, thanks to its favorable climate and extended golf season. The region enjoys pleasant weather throughout the year, with rain during open house viewings being a rarity—so much so that the last significant instance was reportedly in the 1980s.
